The announcement from President Trump’s campaign legal team from November 22 shocked many Sidney Powell supporters.

Many Trump and Powell supporters think that the US president’s case for election redress is sunk.

Here is what is happening. My post from Monday, November 23, offers background, including the Trump team’s announcement.

What Sidney Powell said

Sidney Powell issued her own statement afterwards. Her work is about ‘We the People’, as is L Lin Wood Jr’s.

Powell’s statement is as follows (emphasis in the original, those in purple mine):

I agree with the campaign’s statement that I am not part of the campaign’s legal team. I never signed a retainer agreement or sent the President or the campaign a bill for my expenses or fees.

My intent has always been to expose all the fraud I could find and let the chips fall where they may–whether it be upon Republicans or Democrats.

The evidence I’m compiling is overwhelming that this software tool was used to shift millions of votes from President Trump and other Republican candidates to Biden and other Democrat candidatesWe are proceeding to prepare our lawsuit and plan to file it this week.  It will be epic.

We will not allow this great Republic to be stolen by communists from without and within or our votes altered or manipulated by foreign actors in Hong Kong, Iran, Venezuela, or Serbia, for example, who have neither regard for human life nor the people who are the engine of this exceptional country.

Sidney Powell

What Trump’s campaign lawyers are working on and what Sidney Powell is perfecting are two different issues.

The Trump realm cannot easily enter the Powell realm because that would complicate things unnecessarily.

REX, whom I’ve quoted before, albeit not recently, has this analysis as to why there is a pincer movement going on:

Rush Limbaugh and Howie Carr want more action

On Monday, November 23, Rush Limbaugh was disappointed that nothing was happening yet from either Team Trump or Sidney Powell.

The Daily Caller carried portions of the transcript from his show (emphases mine):

You call a gigantic press conference like that, one that lasts an hour. And you announce massive bombshells, then you better have some bombshells, there better be something at that press conference other than what we got,” he explained.

Limbaugh went on to say that a witness — even one whose identity was disguised — would have gone a long way toward bolstering the claims made by the president’s team.

“But you don’t — you can’t — I talked to so many people who were blown away by it, by the very nature of the press conference,” Limbaugh continued. “They promised blockbuster stuff, and then nothing happened. And that’s just, that’s not — well, it’s not good. If you’re going to promise blockbuster stuff like that, then there has — now, I understand. Look, I’m the one that’s been telling everybody, this stuff doesn’t happen at warp speed, light speed, the way cases are made for presentation in court. But if you’re going to do a press conference like that, with the promise of blockbusters, then — then there has to be something more than what that press conference delivered.”

Limbaugh concluded by saying that if the Trump team was going to make a case, it needed to be done quickly. “Time, of course is of the essence now, as it is speedily vanishing. So they’re going to have to act fast,” he said.

The Howie Carr Show, now a Newsmax programme, came on in the afternoon.

Howie couldn’t get hold of Sidney Powell for another interview, but he did speak with Boris Epshteyn and Joe diGenova. The next few paragraphs are my potted summary of what they told Howie.

Boris Epstein, part of Trump’s campaign legal team spoke to Howie. Epstein said ALL the states in question are still in play. He appeared during Howie’s Newsmax hour. (Howie wears a jacket and tie during that portion of his broadcast.)

Epstein said they are tracking things very closely and said he wanted to reassure Newsmax viewers that everything is in hand and progressing as planned.

Joe diGenova was on Howie Carr’s Newsmax hour after Boris Epshteyn. Joe diGenova said that there IS a two-pronged strategy in play. He said that Sidney Powell doesn’t have any problem pursuing the voting machines angle while Team Trump pursues what went on in the polling stations with no Republican observers admitted or placed so far away that they couldn’t see anything.

He confirmed what Boris Epshteyn said: ALL the questionable states were still in play that day (and this week).

Is President Trump worried about paying for recounts and/or audits in individual states? Based on 2016 and the four years of lefty turmoil that followed, his team were prepared and set money aside, especially as mail-in ballots were heavily promoted in all Democratic-controlled states or cities.

Trump knew his campaign would need to pay for recounts. That’s $3 – 7 million per state. They have that covered.

For those who think Trump should take Al Gore’s advice and concede, in 2000, when the hanging chad contest in Florida was in dispute, Gore didn’t concede until December.

But I digress.

Back to Howie Carr. As an organised crime reporter for the Boston Herald for many years, he knows how the legal system can be manipulated. On Monday’s show he asked whether Sidney Powell’s legal standing would be questioned. On whose behalf could she credibly make her case? (After all, L Lin Wood Jr’s case in Georgia got thrown out last week for lack of standing. He is going to appeal the decision.)

It turns out that Sidney Powell is a military lawyer. As today is still Thanksgiving Day, the ultimate American feast, here’s the retweet:

Patience required — more information emerging

An American Thinker article by Andrea Widburg puts the election legal fight into perspective:

Currently, I believe that this election was marked by epic fraud.  You cannot convince me that Biden, who got five or six people to his rallies, as opposed to the 52,000 or so at Trump’s rallies in Pennsylvania, ended with more votes than Obama.

Nobody ever said proving this fraud would be easy (or, sadly, even possible).  I’m treating its unfolding like an epic novel with a surprise ending

So should the rest of us.

Imagine if we were on the legal team. We wouldn’t have time to sleep — or contemplate our annual turkey dinner with all the trimmings.

Last week I posted about lawyer L Lin Wood Jr’s fight for voting justice in Georgia following the 2020 election in the United States.

A longtime reader of mine, Truth Unites And Divides, sent in an update, an article from Law & Crime: ‘Trump-Appointed Judge Rejects Lin Wood’s Georgia Lawsuit’.

Excerpts follow, emphases in purple mine.

On November 19, Judge Grimberg found that Wood had no standing to sue the state as an individual voter or suing about how votes have been tallied since the 2020 primaries in Georgia:

While Wood sued in his capacity as an average Georgia voter, the judge made clear that this did not give the lawyer a basis to sue.

“There is no doubt that the right to vote, even an individual’s right to vote is sacrosanct,” Judge Grimberg added, adding that this “doesn’t mean that individual voters have the right to dictate” the manner in which that vote is counted.

On the surface of his lawsuit, Wood claims that Georgia’s Republican Secretary of State Brad Raffensperger harmed him as a voter by agreeing to a March settlement agreement on signature matching in ballots. The lawyer waited eight months and three election cycles to challenge it on Nov. 13, when it became clear that President-elect Joe Biden had won.

On Friday, November 20:

The day after ruling from the bench during oral arguments, Judge Grimberg issued his written opinion reiterating his remarks from the bench.

“The Court finds that the threatened injury to Defendants as state officials and the public at large far outweigh any minimal burden on Wood,” Grimberg wrote in the conclusion of his 38-page order. “To reiterate, Wood seeks an extraordinary remedy: to prevent Georgia’s certification of the votes cast in the General Election, after millions of people had lawfully cast their ballots. To interfere with the result of an election that has already concluded would be unprecedented and harm the public in countless ways.”

That is assuming the votes were legitimate. More on that below.

Things are very strange in Georgia at the moment.

Something isn’t right:

The Georgia Secretary of State issued a correction Friday afternoon, saying this state is still completing the certification process, despite an earlier announcement that the state had certified an electoral victory for Joe Biden.

Meanwhile, something suspicious was taking place:

That night, voters from across Georgia went to the governor’s mansion to protest:

Last Thursday, voting machines were dumped outside of Savannah. Why would they have been on the roadside? Why were they not disposed of properly?

Lin Wood has a petition requesting that a special session of the Georgia state legislature be convened:

Any American voter can sign it. Georgia’s outcome will have an impact on the national result:

As I posted yesterday, Judge Jeanine Pirro interviewed Wood on Saturday, November 21:

Wood explained to Judge Jeanine that many Georgia legislators did not know that the voting law had been changed in March, in time for the primaries.

This is why he filed his own lawsuit only recently.

He plans to file for an emergency hearing, if necessary a district court, after his case was dismissed on Friday.

Fortunately, Lin Wood never gives up and is aware of what lies ahead — and not only for him. He calls for those of similar spirit to join him:

So much news came out about the US election late last week that it was not possible to cover it all.

Below is a summary of more news.

Trump team press conference — November 19

On Thursday, November 19, lawyers representing the Trump campaign gave a two-hour press conference. Press Secretary Kayleigh McEnany was also present.

Sidney Powell interviews — November 20 and 21

During the afternoon of Friday, November 20, Sidney Powell gave an interview to Howie Carr on his radio show. Here’s the podcast.

She said that this fraud was co-ordinated internationally (e.g. Canada, Lichtenstein, China) and that its extent is ‘absolutely terrifying’.

The Supreme Court will definitely want to hear this case as, from what she says, it involves foreign interference in a US election.

She also says there were ballots continually run through for Biden at Trump’s expense.

There was also fractional fraud going on. She said a vote for Trump counted 0.75 and one for Biden counted 1.25.

David J Harris Jr has more on the interview:

That evening, she gave an interview to the Washington Examiner‘s Larry O’Connor which you can listen to here.

She told him that ‘multiple people’ saw the fraud take place in real-time. In addition to the above, she said there were military votes, overwhelmingly for Trump, that were not counted.

She told O’Connor that she has testimony and affidavits to prove what occurred:

She hopes to file a formal complaint soon about election fraud that ‘will make jaws hit the floor’.

She says that the machines are so fraudulent that the upcoming run-off state election in Georgia should not take place. The machines can be programmed to get the desired result.

On Saturday, November 21, Powell appeared on Newsmax:

She said she plans to begin with Georgia, calling their current result ‘a total farce’:

Georgia is the first state I’m going to blow up and Mr Kemp and the Secretary of State need to go with it.

No doubt many saw the following statement dated September 22 from Rudy Giuliani and Jenna Ellis regarding Sidney Powell:

It is unclear what that actually means.

However, she might be digging deeper, beyond the election result:

The voting machines

In the video below, Michael Voris explains in layman’s terms how more votes went to Biden than to Trump on the evening of Tuesday, November 3:

The next video is also informative as it discusses what happened in the hotly contested Bush-Gore election of 2000, involving Florida’s hanging chads. Incredibly, those machines are still in use in some states. They also paved the way for the current machines from Dominion and Smartmatic, which, just to repeat, are completely programmable:

Interestingly, three days after the election Shaffer tweeted this about the Department of Homeland Security’s preparedness for the Democratic National Committee:

About these tweets, Gateway Pundit said on Saturday, November 21 (emphasis in the original):

These tweets caused an uproar on Twitter and liberals freaked out thinking they might have gotten caught in their attempt to steal the 2020 election. But the entire discussion was soon forgotten by the media and on Twitter.

Now with Sidney Powell’s claims the President won the election by a long shot, we wonder if what really Shaffer was hiding and referring to at the same time was the election fraud relate to the voting machines? Shaffer is an expert on the machines, maybe he was telling us they were all over it and not to worry?

This just a hunch but ultimately time will tell.

The ‘scandal of the century’

On November 19, a Louisiana newspaper published a report on the election. The Central City News calls it ‘the scandal of the century’:

With that in mind, no wonder President Trump has been tweeting frequently about it:

Regardless of ‘news’ reports, Pennsylvania is still in play with regard to lawsuits:

Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency (CISA)

On November 16, 2018, President Trump established the Cybersecurity and Infrastructure Security Agency, CISA.

CISA is part of the DHS, the Department of Homeland Security. Wikipedia states (see above link) CISA’s purpose is to:

improve cybersecurity across all levels of government, coordinate cybersecurity programs with states, and improve the government’s cybersecurity protections against private and nation-state hackers.[3]

CISA has Election Infrastructure Sector Coordinating Council.

Incredibly, the council has a number of entities which seem somewhat misplaced for the Trump administration. How they got there, who knows?

Excerpts follow, emphases mine.

CISA disputed anomalies with the 2020 election results:

the Cybersecurity and Infrastructure Security Agency (CISA)—part of the DHS—issued a statement on November 12, 2020 disputing the allegations and saying “the November 3rd election was the most secure in American history.” However, what CISA failed to disclose is that Dominion Voting Systems is a member of CISA’s Election Infrastructure Sector Coordinating Council, one of two entities that authored the statement issued by CISA.

You couldn’t make this up:

It is incredible that in addition to Dominion Voting Systems, Smartmatic and SCYTL are also members of the Coordinating Council. In addition, Hart InterCivic electronic machines were used in many states with questionable lack of security, the anti-Trump Associated Press, and Big Tech companies Amazon and Microsoft.

The statement about the election also says:

There is no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised. “While we know there are many unfounded claims and opportunities for misinformation about the process of our elections, we can assure you we have the utmost confidence in the security and integrity of our elections, and you should too,” says the statement.

Meanwhile:

President Trump lawyers Rudy Giuliani and Sidney Powell have denounced Dominion Voting Systems with the Smartmatic software from Communist Venezuela saying that this voting system has shifted millions of votes from Trump to Biden.

Fortunately, on November 17:

President Trump acted wisely when firing Christopher Krebs, the first Director of the Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency (CISA), and Krebs’s second in command, Matt Travis. A third official, Bryan Ware, Assistant Director for Cybersecurity, resigned.

Many insiders investigating the election think more needs to happen:

The President needs to tell the nation what the CIA did and fire its Director, Gina Haspel, as recommended by his lawyer Sidney Powell. The President needs also to tell the nation what Dominion Voting Systems did and its ties to the Communist Democratic Party. Then the President’s lawyers need to take his case to the Supreme Court. Failure to do that may eliminate his chances to return to the White House for a second term.

Lastly, the President also needs to fire FBI Director Christopher Wray for covering up the stolen election and the crimes of Joe Biden and his family. And his lack of cooperation with Congressional oversight committees.

The whole article is well worth reading.

That could be part of the reason why Trump replaced Secretary of Defense Mike Esper with Acting Secretary of Defense Christopher Miller. At the end of last week, Miller announced that the US president’s orders will be carried out. The Special Operations civilian leadership will report directly to Miller instead of the ‘current bureaucratic channels’. This has been authorised by Congress, he said, and will put Special Operations Command on a ‘direct par’ with ‘the military services for the first time’ and will ‘immediately improve agility’.

The text preceding his video (see second tweet) is the author’s alone. Miller did not say those words:

Judge Jeanine Pirro sums up

Judge Jeanine did not let her audience down on Saturday, November 21.

She says that, for four years, we were led to believe that Russia was behind the 2016 election. Yet, this year, we discover that American votes were counted overseas. She adds that Trump’s legal team have 250 affidavits — sworn testimony of evidence — pointing to voter fraud. She explains the pause in vote counts on November 3:

She says that, while Democrats run free, those who filed affidavits will likely need witness protection for telling the truth. Ordinary citizens are being censored for tweeting about voter fraud. Judge Jeanine tried it out with a friend of hers. Jeanine’s was posted. Her friend’s was suppressed. Yet, the greatest issue remains — if proven, this manipulation of votes is unconstitutional:

Yesterday’s post featured top lawyer L Lin Wood Jr’s work for President Trump’s campaign team to prove voter fraud in Georgia.

Today’s post features another top lawyer, Sidney Powell, who is also working on the voter fraud issue for Team Trump. She is well known to Trump supporters for her continuing tireless work representing Gen Michael Flynn.

Of Ms Powell, Lin Wood says:

I mentioned Sidney Powell earlier this week in my summary of Judge Jeanine Pirro’s Fox News programme of Saturday, November 14.

Like Lin Wood, Powell is a redoubtable Southerner.

Breitbart’s John Nolte wrote about both lawyers on Monday, November 16 — ‘Nolte: Sidney Powell and Lin Wood Promise There’s a Ton of Voter Fraud’.

Of Powell, Nolte writes (emphases mine):

Sidney Powell is no joke. She served as a federal prosecutor for ten years and earned a national reputation as the attorney who swooped in, convinced Ret. Gen. Michael Flynn to withdraw his guilty pleas, and successfully pressured the Justice Department to drop its charges. She was a stalwart and regular presence in exposing the Russia Collusion Hoax, and by my count, everything she said was going to happen did happen.

This is a serious woman. There’s no circus atmosphere around her. And she is pledging, as she did over the weekend on Maria Bartiromo’s Sunday Morning Futures, that they have the goods, that they can prove there was enough voter fraud to overturn Joe Biden’s lead.

“There has been a massive and coordinated effort to steal this election from we the people of the United States of America, to delegitimize and destroy votes for Donald Trump, to manufacture votes for Joe Biden,” she said.

Sidney Powell has been examining voter fraud in several states, including the swing states so important to Trump’s results (see the Lou Dobbs video in this link).

On Friday, November 6, three days after the election, she told Lou Dobbs that the voting machines are partly to blame. The operation referred to below is one that US intelligence agencies use in foreign countries when they want to influence an election result. This operation was never intended to be used against the American people. And yet …

On Sunday, November 15, Powell gave an interview to Maria Bartiromo. She said that information has been coming in so quickly and in such volumes that she is struggling to ‘process it all’. She explained the connection between the voting machines and a member of Joe Biden’s transition team, a retired Navy admiral:

Real Clear Politics has more on Powell’s interview with Bartiromo. Powell said that CIA director Gina Haspel should be dismissed:

President Trump’s lawyer Sidney Powell told FNC’s “Sunday Morning Futures” with Maria Bartiromo that CIA director Gina Haspel should be fired for ignoring warnings about the Dominion voter software ahead of the 2020 election.

“It should never have been installed anywhere and we are going to show the public exactly how rotten the entire state is,” she said.

“Why Gina Haspel is still there in the CIA is beyond my comprehension,” Powell said. “She should be fired immediately.”

Wow.

What exactly, though, does ‘releasing the Kraken’ mean in terms of the election?

Clarice Feldman, a regular contributor to American Thinker, reminds us that, on September 12, 2018, Trump issued an Executive Order (EO) prohibiting foreign influence in American elections:

it cannot be doubted that two years ago he anticipated foreign interference with our election process and issued in an Executive Order a means to investigate and punish any person, group or country which engaged in such international election fraud

It’s a lengthy order and I’ll try to note some of the most significant portions of it. It tasks the DNI with preparing a report of the investigative results of such interference no later than 45 days after an election

Clarice Feldman goes on to elaborate on the contents of the EO. She says:

Did this Executive Order set in place a means to investigate computer manipulation overseas to affect our election and did such an investigation reveal that this occurred and significantly affected the election in several key states? If so, the reported results must be amended substantially to discard the false count, or other measures taken to prevent certifying fraudulent results dependent on the manipulated reported final tallies. That is the issue I think Powell and Wood are hinting at.

To be sure, there is a great deal of evidence of regular old-timey ballot stuffing and standard election fraud, but computer and internet generated mischief has the potential to far exceed that and seems to Trump’s lawyers in fact to have done so.

Feldman then describes what has happened with Georgia’s results and discusses the voting machines involved.

She concludes:

At the Department of Defense, General Michael Flynn’s aide Ezra Cohen-Watnick has been made acting undersecretary of intelligence. Previously he was the U.S. strategic policy coordinator for all intelligence programs, “including, among other things, covert action, human intelligence, electronic surveillance.”

Are Trump’s lawyers onto something big or not? We’ll have to see

Sidney Powell went so far as to say:

On November 17, Newsmax reported that Michigan’s Wayne County refused to verify election results, which could send the decision to their state’s legislature. Powell told Newsmax presenter Greg Kelly that this was good news. She had more to say about the voting machines, which allegedly have a ‘back door’ for manipulation — ‘a feature’ not a bug. She says she has it on good authority (a former Venezuelan military officer) that it worked successfully for Venezuela’s Chavez and Maduro. The presenter said it’s no wonder Biden didn’t campaign. She is still in the process of gathering more information and hearing from more people every day who want the fraud revealed and stopped:

The next six tweets are particularly important:

Powell told Newsmax’s Greg Kelly (see video above) that Trump received 80m votes in a clear landslide. The voter fraud, she says, is ‘very serious’ and involves ‘trillions of dollars of worldwide wealth’.

Powell is still putting together evidence and testimony, but millions await her ‘release of the Kraken’ with great anticipation.

On Thursday, November 19, Sidney Powell participated in a press conference with former New York mayor Rudy Giuliani and attorney Jenna Ellis, who also helped to defend John MacArthur’s Grace Community Church against lockdown rules in Los Angeles County.

Howie Carr’s audio from November 19 has excerpts of what Powell said. She sounded disgusted and saddened, in equal measure. She said that she will continue to pursue the voter fraud.

When you hear her allegations in that audio, it is difficult to comprehend just how appalling it must be to discover voter fraud on such a massive scale.

I wish Sidney Powell all the very best as she pursues the truth not only for President Trump but also America, the Great Republic.

The investigation into President Trump’s vote count in the US election continues.

Several avenues appear to be closed at this point, e.g. in Pennsylvania.

However, the state of Georgia is still under the spotlight.

One of the lawyers helping out Team Trump is Lin Wood, who, earlier this year helped 18-year-old Nicholas Sandmann win a huge lawsuit against the Washington Post. Nicholas Sandmann was the high school student in Covington, Kentucky who was verbally attacked after the 2019 March for Life in Washington, DC. The media had a field day and accused the student of provoking the verbal attacker, who turned out to be an activist.

The story was on television and in the newspapers for days. Those reports carried many false statements about Sandmann, which put him, his family and his school in potential danger for some time.

In the end, on July 24, 2020, Nicholas Sandmann thanked Lin Wood and fellow lawyer Todd McMurtry for the wildly successful result:

And I’m just this confident that Joe Biden and the people like him that been trying to steal this election and committed crimes for years they will all go to jail.

Howie Carr: What leads you to be so optimistic? There’s time but we are coming up on dates of voter certification.

Lin Wood: I believe in We the People. This was a well planned, almost for two decades attack to overthrow our government. Was it well done in the sense to hide the fraud? Sure. But it was too massive!… The process will show that they themselves killed several people in this country.

Wood spoke again with Howie Carr on Monday, November 16. Howie asked him how positive he was compared with last week.

Wood responded that he was 100% the week before (November 11) and was 105% positive this week (audio here, which includes a separate interview with another lawyer, former US Attorney Joe DiGenova, who is also investigating voter fraud for Team Trump):

Doug Ross studied graphs from the New York Times showing Pennsylvania’s and Georgia’s ballot tabulation. Ross says (highlights in purple mine):

The charts below are derived from The New York Times‘ real-time election feeds (e.g., here). They show “DNA-level” evidence of vote fraud that was systematically used to overcome massive Trump leads with “vote flips” to Biden.

The twin charts below depict the shifts in votes starting on election day. The X-axis is the date/time and the Y-axis represents the change in votes (positive values denote shifts for Trump, negative values represent shifts for Biden, in hundreds).

Notice the similarities in PA and GA? How the right sides of the graph show virtually no movement for Trump; and very predictable vote movements to Biden. How predictable?

Below are excerpts of spreadsheets that show what was happening on the right side of each chart. Vote flips in the same-sized bundles (6,000 in PA and 4,800 in GA) were injected into the system to overcome Trump’s lead in both states. You can click either image above to see all of the data.

The highlighted cells show where the vote counts — stunningly obvious in retrospect — were manipulated to benefit Biden.

Note the vote flips, represented by the highlighted cells, that occurred in both PA and GA. In PA, late vote flips in bundles of around 6,000 were clear anomalies to slowly overcome Trump’s lead. In GA, the bundles were in 4,800 vote swaps.

On Sunday, President Trump retweeted the introduction to Watters’ World from Saturday, November 14:

It’s a great 8-minute long video.

Watters notes President Trump’s many accomplishments over the past four years and finds it inconceivable that he would not win re-election, particularly when Joe Biden was such a lacklustre candidate. He also pointed out that Republicans had very good election results.

Watters also cast doubt on the voting machines and software as well as the coralling of Republican vote watchers, who were told to stand so far away that their presence was meaningless.

Watters is prepared to say he was wrong only after every vote has been counted. However, he says that this was the first election to have so many mail-in ballots and, with little to no signature verification and ballots allowed after Election Day, it was a recipe for fraudulent voting.

Watters says that if mail-in ballots are the wave of the future, the United States will never have an honest election again. Americans will lose trust in the voting system.

Wherever we live in the Western world, our vote is the only voice we have. I feel for the American people.

I hope that Jesse Watters is right in his conclusion that Trump will be back for a second term.

Judge Jeanine Pirro had to take a Saturday off because Fox News did not want her to discuss voter fraud in the US election:

Fortunately, she was back on November 14 to examine the topic.

Rep. Jim Jordan from Ohio pointed out that Republicans have unseated some Democrats down ballot. New Republican winners are women, minorities and veterans. He also said that with so many Republicans winning those down ballot races, it is illogical that a GOP presidential incumbent would lose the election:

The Republican leader in the House of Representatives, Kevin McCarthy from California, echoed what Jim Jordan said but added that it is essential that every legal vote be counted in this election:

Gen Michael Flynn’s attorney Sidney Powell talked about the voting machines and software used in the election, casting doubt on both:

Georgia congressman Doug Collins joined Judge Jeanine to discuss voting irregularities in that state and the lawsuits filed there:

Finally, Corey Lewandowski, Trump’s first campaign manager in 2016, told Judge Jeanine how he was unable to watch Philadelphia’s vote count even with a court order allowing him to do so. He was allowed in to the city’s massive convention centre only after the votes were counted:

Corey Lewandowski also caught coronavirus and had to return home to New Hampshire. He told Judge Jeanine that he had very few symptoms and has now recovered.

Meanwhile, the (re)counts continue.

The results for the 2020 US presidential election have never been so confusing.

In 2000, when Al Gore ran against George W Bush, life was so much simpler: Florida was the only state where the results were in dispute. Those were the days of the hanging chads.

On Tuesday evening (US time), November 10, I checked election maps in the Telegraph and at Real Clear Politics. The Telegraph had Pennsylvania, with 20 electoral votes, going to Biden. Real Clear Politics, based in the US, had the state undeclared.

At the time I checked both maps, People’s Pundit Daily tweeted:

Neither map had this result posted.

Additionally, I could not find where North Carolina’s State Board of Elections called the result.

Even so, Thom Tillis’s opponent conceded that day:

There are two more maps I looked at that night (as it was in my time zone) — People’s Pundit Daily‘s and the one at Power Elections:

Note that, on the night of November 10, the Power Elections map was showing Wisconsin and Minnesota still undecided — along with Pennsylvania.

Meanwhile, People’s Pundit Daily showed only Arizona and Georgia still in play.

As far as electoral votes go, Power Elections had Biden up by one. People’s Pundit Daily had Biden up by 50 (279-229).

I’m not blaming any of these outlets for confusing the issue, but, until this year, maps were pretty well unified after the election.

Rudy Giuliani, incidentally, seemed satisfied that Real Clear Politics changed their result for Pennsylvania (note Twitter’s response):

So, what happens when an election result is in dispute across the nation?

A. S. Haley, better known online as Anglican Curmudgeon, explained what the constitutional course of action is in his November 8 post, ‘Down to the Brass Tacks’.

My fellow churchman wrote an excellent article. A big tip of the hat goes to another fellow churchman, Underground Pewster, for the link.

Excerpts follow. Emphases mine, except where noted otherwise.

First of all, for my readers who are not American, please note (emphases in purple mine):

the rush to “call” a winner of the 2020 election has been driven by the major news networks, who are unanimously biased against President Trump. But the media have no power under the Constitution to declare anyone as “President-Elect”. That title may be bestowed only upon the winner in the Electoral College vote of December 18, or if not there, then upon the candidate selected by the new House of Representatives that convenes on January 3, 2021. 

The Electoral College will meet on December 14 and the results will be available on December 18.

The US Constitution and pursuant Congressional statutes make the following provisions:

By Congressional statute (3 U.S.C. § 7), enacted pursuant to Article II, Sec. 1, cl. 5 of the Constitution, the Monday after the second Wednesday in December of a given Presidential election year has been specified as the date on which all State electors are to meet in their respective State capitals and cast their ballots for both President and Vice President. In 2020, that date falls on December 14.

Normally, the electors for any given State are those persons who (first) have been nominated beforehand by a registered political party or independent candidate within that State (or Congressional district), and then (second) who have the fortune to have their Presidential candidate receive the highest number of votes cast in that State (or district) in the November election. But when is it determined that a given Presidential candidate has received the requisite highest number of votes?

Ay, there’s the rub. Again normally, the vote tallies in the various counties and districts of the State are completed within a day or two of Election Day, and are clear enough so that there can be no dispute about which candidate got the most votes. But occasionally, as happened in the Presidential election of 1876, and as almost happened in the Presidential election of 2000, there were disputes about which candidate prevailed in various States, so that the slate of electors entitled to cast votes for their respective candidate was rendered uncertain. The Constitution specifies that in such cases, as well as in any case where no candidate receives a majority of the Electoral College votes, the final selection of the President goes to the newly elected US House of Representatives, and the selection of the Vice President goes to the newly elected Senate.

That last sentence is very interesting. If Nancy Pelosi remains Speaker of the House presiding over a Democrat majority, Biden would be president. Mitch McConnell, Senate Majority Leader, and the Republican majority could select a Republican VP. Talk about fireworks.

A S Haley compares and contrasts 2020 with 2000:

As regards the election results in Pennsylvania, North Carolina, Georgia, Michigan, Wisconsin, Arizona and Nevada, we are witnessing a repeat of what happened in Florida in 2000.  You may recall that the then Democratic Party candidate Al Gore contested the official count in certain counties of that State in favor of the Republican Party’s George W. Bush. Gore, however, was under a deadline to have the recounts he requested resolved in his favor before the Florida Secretary of State certified the official count to the Governor, who would then sign the certificates attesting selection of the Republican slate of electors to the Electoral College.

Again, Congress has legislated what happens when there is a dispute in any given State over its proper slate of electors. Section 5 of Title 3, U. S. Code, provides that if election results are contested in any state, and if the state, prior to election day, has enacted “procedures to settle controversies or contests over electors and electoral votes”, and if these procedures have been applied, and the results have been determined six days before the electors’ meetings, then these results are considered to be conclusive. Six days before the prescribed meeting of the Electoral College on December 14 of this year falls on December 8. (The date is referred to as “Safe Harbor Day”, because the statute makes any resolution of election disputes reached by that date presumptively conclusive, i.e., not subject to further contest.)

Therefore, the contested results need to be ‘resolved’ by December 8. However, even then, there is a provision when they are not:

Here again, however, the federal nature of our Union kicks in. For while it probably will not be practical to have all contests in all disputed States determined in the courts by December 8, it may suffice for one such dispute to have been finally determined at the highest possible level by that date, if that determination is definitively made by the United States Supreme Court (SCOTUS), and if it fairly applies in the other cases, as well. That is because, under our federal system, the rulings of SCOTUS on federal law are automatically binding on all lower courts, both federal and State.

I learned this years ago in US History class, at least twice, but never imagined that this fateful day might come to pass in my lifetime. It seemed so hypothetical decades ago. Today, in November 2020, we could be at that point.

The biggest issue revolves around Pennsylvania (20 Electoral College votes) during a year of coronavirus. Pennsylvania encouraged voters to use postal votes instead of appearing in person to vote this year. The Republican Party of Pennsylvania has brought a case against the secretary of state, Kathy Boockvar:

which challenges the decision by a unanimous Pennsylvania Supreme Court to (1) extend the statutory deadline for receipt of all mail-in and personal ballots by three days after the legislated deadline of 8 p.m. on November 3; and (2) require the various election boards to include in their counts any ballots received by the extended deadline which could not definitively be shown to have been mailed after November 3 (i.e., ballots in envelopes bearing blurred postmarks, or even no postmarks at all). This ruling, be it noted, shifted the burden of proof from the individual voter to the given elections board to establish that a ballot was not sent in by the statutory deadline — and why would a Democratic-majority elections board try to prove that a ballot for their candidate had not been sent in on time?

Supreme Court Justice Alito issued an order requiring that the Pennsylvania ballots arriving after Election Day be segregated apart from those that arrived on time:

pending action on the petition for review by the full court.

Haley says that the Supreme Court could issue further orders in the days to come.

Can the Supreme Court help Trump? Haley says that things could become quite technical legally. The result could go either way:

Here is one very strong summary of the issues for the Republican petitioners, and here is another informed view that calls into question whether SCOTUS will grant any definitive relief. In the words of my previous post, “you pays your money and you takes your choice.”

As for the Electoral College, this is how electors are chosen:

Here is the language of Article II, Section 1, clause 2, which has been with us since the original document was ratified in 1789 (with my bold emphasis added):

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

Thus if the various State and federal courts prove inadequate to the task of resolving the election disputes in each contested State before the Safe Harbor day of December 8, the Legislatures of those States are empowered to step in and resolve the disputes by designating their own slates of electors. And it has not gone unnoticed that of the disputed States (Pennsylvania, North Carolina, Georgia, Michigan, Wisconsin, Arizona and Nevada), all but Georgia have Democratic governors, as well as Democratic Secretaries of State, and Democratic election officials, while they each (except for Nevada) have legislatures in which both houses have Republican majorities.  

However, will the states have the nerve to:

exercise their Constitutional power to resolve those disputes definitively, in time for the final vote of electors by December 14? On the answer to that question depends who will be President on Inauguration Day, January 20, 2021.

Haley rightly blames this year’s election chaos on the Democrats for their notional coronavirus concern with mail-in ballots.

If the lawsuits against individual states and the Supreme Court come to nothing in resolving the election result, then Americans have only the House of Representatives — congressmen and women — left.

There is a chance that Republicans could still control the House of Representatives:

If the vote does go to the new House of Representatives:

the vote for President will not be by a majority of its individual members, but (again as specified in the Twelfth Amendment) by the collective delegations for each State in the House, with each delegation having a single vote. As of the latest results for the 435 House elections, Republicans on January 3 will control 26 of the State delegations, and will thus have a majority of the 50 delegations so voting

In conclusion:

what happens between now and January 20, 2021 is pretty much up to the Republican legislators elected to Congress and to their various State legislatures.

Let us hope for the best.

As per their YouTube blurb, Andrew Neil’s special guests are:

David Spiegelhalter, Winton Professor of the Public Understanding of Risk at the University of Cambridge [and] Ece Temelkuran, a Turkish journalist who was fired from her publication for criticising the government.

Andrew Neil began with the US election. Neil clearly loathes Trump. This is why I have not listened to or posted the previous two broadcasts.

He did mention that the state legislatures have a big part to play in deciding whether their election counts are legal or if they can take other action. Political Editor James Forsyth said this was not the predicted Blue Wave Democrats and pollsters predicted. As such, the Republican-dominated Senate will put a check on how much Biden, should he become president, could do.

Economics Correspondent Kate Andrews, who is American, said that to Trump supporters, the incumbent represents ‘normality’. She is not a Trump fan, by the way. She said that Trump will not go down without a fight in the courts, especially after the Democrats have dogged him since 2015. She also pointed out how wrong the polls were.

Neil said that the Democrats never seem to learn their lessons, beginning with Hillary Clinton in 2016. He also said that Biden made a mistake in offering a huge concert featuring Lady Gaga; it looked to ‘Flyover Country’ as if he were pandering to multi-millionaires.

Forsyth pointed out that there is still deep division in the way that Americans think. Neil mentioned the upcoming litigation from Team Trump and mentioned voter fraud, including mail-in ballots. Forsyth said that Establishment Republicans, e.g. Mitch McConnell, will not want him to move into the territory of ‘vexatious lawsuits’.

Neil noted that Democrats are hardly triumphant, particularly because of Biden’s age: 78. Kate Andrews replied that their mandate will be unclear for a one-term president. [They are both assuming Joe’s going to last for four years.] She disagreed with Forsyth about coronavirus being the reason Trump didn’t get more votes; she thinks that Trump came on too strong in the first debate. [The presidential debates are supposed to sway the undecided.]

Andrews think that Biden will ‘work across the aisle’ if he becomes president. However, she says there’s a long road ahead before the president is decided.

Forsyth says that chances are good that Republicans will continue ‘Trumpism without Trump’, building more links with the working class and those on lower incomes. He thinks Democrats have more work to do here than Republicans.

Neil said that the Midwest could take the coastal areas over as the deciding region in future elections — for both parties. Andrews said that people there really appreciated the 2017 tax breaks. The economy, from what she has seen in exit poll issues, was much more important than coronavirus.

Neil said that if Biden becomes president, he will face a Republican-controlled Senate and a majority-conservative Supreme Court. [Neil and Andrews haven’t allowed for him to stack the Supreme Court.]

At that point, both Neil and Forsyth started showing their vulnerabilities as pundits on US politics. So, I’ll move on to the next topic.

The next topic of discussion was the second coronavirus lockdown in England, paralleling the one in Wales and something similar in Scotland. It started the day of the broadcast.

The Spectator‘s editor, Fraser Nelson, talked about the ‘debacle’ of spurious data from SAGE that appeared at the press conference on Saturday, October 31, which 15 million people watched. He pointed out that there are nowhere near 4,000 daily deaths from coronavirus. The magazine has been tracking the data daily.

Nelson also mentioned Sir Patrick Vallance’s exaggerated projections from September, which were not at all true. Nelson said that it looks — even before lockdown — as if the Government’s localised tier system is working. Liverpool’s case numbers decreased by 48%, he said, in the second half of October. He concludes that the Government pushed lockdown based on modelling rather than reality, i.e. ‘scary charts’. [I couldn’t agree more.]

Prof David Spiegelhalter appeared remotely. Neil asked him about these strange statistics and scary scenarios. Spiegelhalter, a statistician, said that he would be speaking personally, not professionally. He said that the ‘4,000 deaths’ were ‘completely unnecessary’ to make a case for a second lockdown. He pointed out that, in more moderate areas of the country, e.g. the south-West, cases are going up. He said that, even as R is decreasing, we are only stabilising the situation temporarily. The situation we are in now is still putting pressure on the NHS to carry out routine treatments. That could have been explained and that would have been reason enough for the public to accept a second lockdown.

Nelson broke in to say that he thought showing alarmist statistics to an early evening audience nationwide on a Saturday was irresponsible. Spiegelhalter agreed, saying that the graph was ‘inappropriate’. He added that it had been produced under earlier, out-of-date assumptions — and was never part of an official document.

Nelson asked for a more balanced view with regard to public statistics. He was also concerned about false-positive test results. Spiegelhalter replied that the true false-positive result is very low. However, we are moving on from the PCR (swab) test we have been using. [A trial with a new test in Liverpool started a few days ago.] He said that the new tests would need to be further evaluated for false-positive rates.

Neil has been talking to the True Blue (Conservative) faithful and they have been growing increasingly ‘hostile’ towards Boris Johnson’s premiership. James Forsyth said there could be a vote on a third lockdown later in the winter. He predicted that there would be an even bigger Conservative backbench rebellion than there was on Wednesday, November 4, when the new lockdown was voted in. Andrews said that the public have not seen enough done during the summer to prevent a further coronavirus crisis. They are also edgy and frustrated about an ever-extended furlough scheme, recently extended to the end of March 2021.

Talk then turned to the ongoing disagreement between France and Turkey, which saw two terrorist incidents in France recently. Ece Temelkuran, an award-winning Turkish journalist and author, was the final interviewee. Neil asked her if Turkey’s President Erdogan was an ‘authoritarian’. She replied, ‘Definitely’. However, she added that the move away from secularism started in the 1980s with members of the military and went on from there. She explained that part of that move was against the Cold War. After the Berlin Wall fell, the military leaders were ‘jobless’ and looked for something with which they could occupy their time. Twenty years ago, after 9/11, Turkey became the ‘model, the exemplar country’ for ‘moderate Islam’, which emerged after 2001, and became stronger advocates for the cause.

She does not think that Erdogan has a plan, that he merely wants power. She says that Erdogan perceives — along with some Turks — that the ‘West has lost its moral superiority’ with the refugee crisis that began in 2015.

She said that Erdogan is increasing his control over various Turkish institutions, ongoing over the past four years. She said that things will get worse before they get better.

President Trump was correct when he said a few weeks ago that the 2020 election would be:

the election of a lifetime.

It has proven to be just that, with reports of voter fraud on an epic scale as the media called the election for the Biden-Harris ticket.

Meanwhile, Twitter users are barely allowed to question the number of votes. Some users get a fact check with their tweet. Some election tweets cannot be retweeted:

Even though some world leaders and politicians are congratulating Joe Biden on becoming ‘president-elect’ — as declared by the media — the vote count in some states had not yet been decided or declared:

In a letter to NBC News, ES&S said it takes “great care” with its foreign supply chain, including conducting risk assessments and making on-site visits to suppliers to make sure that components “are trusted, tested and free of malware.”

Fraction magic could only do so much. When it had done all it could, that’s when human intervention came in:

US intelligence agencies have a system they use overseas to change election results. It is called Hammer & Scorecard. Gen Michael Flynn’s attorney Sidney Powell alleges that the same system was deployed on the American people last week. She tells Lou Dobbs that it would have been run at a very high level — so, not by poll workers — and said, ‘This is Coup 5.0, Lou’. She added that the Justice Department still wasn’t listening. The memo was addressed and signed from Barr to U.S. Attorneys, the assistant attorneys general for the DOJ’s criminal division, civil rights division, the national security division, and the director of the Federal Bureau of Investigation (FBI), Christopher Wray …

Barr’s memo comes after 39 House Republicans pressed Barr in a letter on Friday to allow available DOJ resources to look into allegations of voting irregularities across the country in several key battleground states. The Trump campaign has filed a number of lawsuits in some of those states.

Barr said in his memo that, although the states have the primary responsibility to conduct and supervise elections, the DOJ has “an obligation to ensure that federal elections are conducted in such a way that the American people can have full confidence in their electoral process and their government.”

He added that while “most allegations” of purported election misconduct are of such a scale that they would not impact the outcome of an election that their investigation can be deferred, “that is not always the case”

He said inquiries and reviews may be conducted if there are clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual state.

“While U.S. Attorneys maintain their inherent authority to conduct inquiries and investigations as they deem appropriate, it will likely be prudent to commence any election-related matters as a preliminary inquiry, so as to assess whether available evidence warrants further investigative steps,” he said …

He noted that his authorization of investigations should not be taken as an indication that the DOJ has concluded that voting irregularities have impacted the outcome of the election, but to ensure trust in the voting process.

Interestingly, the Justice Department official who oversees investigations of voter fraud, Richard Pilger, resigned hours later:

As interviews are conducted in the field and hard evidence accumulated with federal prosecutors building cases and the need for a “Rocket Docket” directly to the Supreme Court, I suspect the conspiracy will crumble as the minions and mid-level political miscreants scurry for legal safe haven. It is simple: As the DHS team chases illegal computer voting “trons,” many of those in criminal legal trouble may see an opportunity to get out of jail free by singing to the feds.

Essentially, “the computer ate my homework” defense, with the press calling it a “computer glitch,” will collapse, and then significant votes may swing back to the correct column.

Sadly, if it takes walking a few conspirators to identify and correct many machine-directed mis-votes, so be it.

President Trump will eventually win. Just look at this early headline at a very local level in the key battleground state of Michigan.

Soon many “computer errors,” I suspect, will be corrected.

However, those election-thief conspirators that took the analog route by corrupting hard-copy ballots, by either throwing away Trump votes and/or adding illegal Biden votes, well, they can become cooperating witnesses. Or else too bad for them because I hope they enjoy their stay at a “Club Fed” and living with a lifelong felony conviction in the thereafter.
